Welcome to the website, customer application and transport services of APEX Shuttle.
These Terms govern APEX quotes, immediate bookings, future reservations, airport and hotel transfers, point-to-point journeys, chauffeur services, customer accounts, payments, tracking and communications.
By making a booking, creating an account, paying for a service or using an APEX digital platform, you acknowledge that you have read and agreed to these Terms.
1. About APEX
APEX Shuttle provides private transport and shuttle services, including airport pickup and drop-off, hotel transfers, point-to-point transport, chauffeur hire and other pre-arranged transport services. These Terms apply to APEX-controlled services unless a specific quotation, booking confirmation, corporate agreement or service provides additional written terms.
2. Acceptance of These Terms
You should not use an APEX service if you do not agree to the applicable Terms. A booking remains subject to availability, acceptance by APEX and any required payment or confirmation steps.
3. Eligibility and Customer Accounts
You must provide accurate, current and complete information when creating an account or booking. You must not use another person's identity, email address, cellphone number or payment information without lawful authority. You are responsible for protecting your account credentials.
4. Bookings and Future Reservations
Bookings may be made through the APEX website, customer application, authorised staff channels or other approved APEX channels. You are responsible for checking pickup, destination, date, time, passenger count, luggage requirements, airport or flight details and other information before confirming a journey.
Future reservations remain subject to operational availability. A driver or specific vehicle may be assigned closer to the scheduled service time.
5. Passenger and Contact Information
You must provide information reasonably required to perform the journey. If you book for another passenger, you confirm that you are authorised to provide the relevant information and to communicate applicable booking information to that passenger.
6. Pickup Locations, Timing and Journey Readiness
You are responsible for supplying a reasonably accurate pickup location and being ready at the agreed time. Estimated pickup, arrival and journey times may be affected by traffic, road closures, weather, security controls, airport operations, accidents, events and other circumstances outside APEX's reasonable control.
7. Airport, Hotel and Flight Transfers
For airport journeys, customers should provide accurate airport, terminal and flight information where requested. APEX may use available flight information to support pickup planning, but customers remain responsible for notifying APEX of material changes. Airline or third-party flight information may be delayed, incomplete or unavailable.
8. Vehicles, Passenger Capacity and Substitution
Vehicle categories are subject to availability. Displayed passenger and luggage capacities help customers select an appropriate vehicle. Customers must not knowingly book a vehicle with insufficient capacity. Where reasonably necessary, APEX may substitute another suitable vehicle of comparable or greater practical capacity.
9. Quotes, Fares and Pricing
Automated fares are based on the booking information provided, configured pricing rules and available route data. Where a fare cannot be calculated automatically, APEX may indicate that it is to be confirmed. A price may be revised before final confirmation where material booking information changes.
10. Payments
Where payment is required, the booking confirmation or payment page will show the amount and available method. Electronic payments may be handled by an external payment provider. A booking is not necessarily treated as paid until APEX receives valid payment confirmation.
11. Booking Changes, Cancellations and Refunds
Requests to amend or cancel should be made as soon as possible through an authorised APEX channel. Any cancellation charge, amendment charge, refund condition or non-refundable amount will be determined by the policy displayed or communicated for the applicable booking, quotation or service.
Where no specific rule has been displayed, APEX will assess the request reasonably with reference to timing, costs already incurred, vehicle or driver allocation and applicable law.
12. Waiting Time, Delays and No-Shows
Waiting arrangements depend on the service and pickup circumstances. Additional waiting caused by the passenger may result in an additional charge where such a charge was disclosed or reasonably agreed. If APEX cannot contact or locate the passenger after reasonable efforts at the agreed pickup point, the booking may be treated as a no-show subject to applicable booking conditions.
13. Luggage and Personal Property
Customers should disclose unusually large, heavy, valuable or specialised luggage where it may affect vehicle suitability or safe loading. Dangerous, unlawful or prohibited items must not be carried. Passengers should check that personal belongings are removed at journey end. APEX will make reasonable efforts to assist with reported lost property but cannot guarantee recovery.
14. Children and Special Assistance
Customers should notify APEX in advance if a child seat, mobility aid, accessibility consideration or other special assistance is required. Availability of specific equipment or vehicle features must be confirmed before travel.
15. Passenger Conduct
Passengers must behave lawfully and must not threaten, abuse, harass, endanger or seriously disrupt a driver, staff member, other passenger or road user. Smoking or unlawful conduct in an APEX vehicle is not permitted. Passengers may be responsible for reasonable cleaning or repair costs arising from deliberate damage or exceptional soiling where permitted by law and appropriately evidenced.
16. Safety and Right to Refuse or End Service
Safety is a core APEX operating priority. APEX or an authorised driver may refuse to start or may safely end a service where continuing would reasonably create a safety, legal or security risk, including serious misconduct, unlawful instructions, dangerous luggage, excessive capacity or unsafe road conditions.
17. Location, Routing, ETA and Tracking
APEX systems may use mapping, geocoding, GPS and route information to support pickup accuracy, route planning, distance, ETA, pricing and journey tracking. Routes and ETAs are estimates and can change because of real-world conditions. Raw latitude and longitude coordinates may be processed internally even where customer and staff interfaces display only readable addresses or place names.
18. Communications From APEX
APEX may contact you by email, SMS, telephone, push notification or WhatsApp in connection with quotes, bookings, payment, account security, driver assignment, pickup, journey changes, reservation reminders and customer support.
19. Third-Party Services
APEX may integrate with providers for payments, mapping, geocoding, flight information, SMS, email, WhatsApp, hosting, analytics and other supporting services. Those providers may have their own terms, privacy policies, availability and technical limitations.
20. Availability of Services
APEX aims to provide reliable transport and digital services but does not guarantee uninterrupted availability. Services may be affected by maintenance, telecommunications problems, hosting failures, payment-provider outages, road conditions, vehicle availability, security incidents, force majeure or other circumstances outside reasonable control.
21. Intellectual Property
Unless otherwise stated, the APEX name, branding, logo, website and application design, software, text, graphics and other original content are owned by or lawfully used by APEX. You may not unlawfully reproduce, commercially exploit, impersonate, scrape protected content or use APEX branding in a misleading manner.
22. Privacy and Personal Information
APEX processes personal information in accordance with its Privacy Policy and applicable South African law. The Privacy Policy forms an important part of the rules governing APEX digital and transport services.
23. Limitation of Liability and Indemnity
To the maximum extent permitted by South African law, APEX will not be liable for indirect, incidental, consequential or special loss arising solely from use of or inability to use an APEX digital service. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or waived.
To the extent permitted by law, a user may be responsible for losses, claims or costs reasonably arising from deliberate unlawful misuse of an APEX service, fraudulent conduct, intentional damage, infringement of another person's rights or material breach of these Terms.
24. Governing Law and Severability
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with under applicable South African law and the jurisdiction of a competent South African court. If any provision is held invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
25. Changes to These Terms
APEX may update these Terms to reflect changes in law, technology, pricing systems, transport operations, security requirements or services. The updated version will be published on this page with a revised “Last Updated” date.
